US Judge Mandates Release of Abrego Garcia from Immigration Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The case originates in a mistaken removal to El Salvador in March, which the government later admitted was an error. Following his repatriation to the United States to face alien smuggling allegations, he was detained in federal custody.
In her decision, the court noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Context of the Case
The court proceedings involve conflicting assertions. While the Trump administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this claim.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
Conditions of Release
The court, who was overseeing his challenge to removal in a federal court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This ruling marks a notable turn in a complicated legal case featuring claims of wrongful detention and contested gang associations.
